Many articles about retaining walls in NSW begin and end with one number: 600mm. Under it, you're usually fine; over it, you'll need approval. It's a helpful starting point — but it's only a small part of the story.
A low retaining wall may not need approval in NSW, but only if it meets all of the relevant requirements — not just a height limit. Boundary setbacks, distance from easements and water, drainage, existing structures, heritage and your site's conditions can all change whether approval is needed. Height is one test among many.
It's worth understanding one distinction first. While retaining wall standards in Australia set the technical benchmarks for how a wall is designed and built, the rules about whether you need approval are decided at a state and local level — which is where NSW-specific requirements come in.
In practice, a retaining wall is rarely just a wall.
Depending on where you live and what your site is doing, it can involve site surveys, geotechnical advice, drainage and engineering, tree assessments, mine subsidence considerations and water authority sign-off — often before council will even look at your plans.
Knowing this early can save you a lot of time, money and frustration, and it helps you decide whether a wall is genuinely the right investment for your home.

First, It Helps to Ask Why You're Building It
Most retaining walls come down to one of two motivations, and it's worth being honest about which one is yours.
The site genuinely needs it. The land slopes, and without a wall your soil moves, your levels can't be formed, water can't be controlled, or your home, pool area or outdoor entertaining areas aren't properly secured. Here, the wall is solving a problem — it exists because the site calls for it.
You'd simply like a flatter yard. Perhaps a neighbour mentioned theirs made the garden "low maintenance," and a level lawn is appealing. That's a completely reasonable thing to want — but here the wall is a preference rather than a necessity, and that's worth recognising before you spend.
There's nothing wrong with wanting flat, usable space. A retaining wall simply shouldn't exist only because a level lawn is easier to picture — it should earn its place in the landscape. If the goal is mainly less upkeep, it's worth considering whether there are lower-impact garden design solutions that achieve the same result without introducing a major structure. A wall can absolutely be the right answer; it's just worth being sure it's your answer.
Do You Need Approval for a Retaining Wall in NSW? The 600mm Idea
The reason 600mm gets quoted so often is that lower walls are more likely to fall into the "no approval needed" category — what NSW calls exempt development.
But height is only one of several conditions that all have to be met, and a low wall can still need approval depending on where and how it's built.
The NSW Government sets out the full list of conditions for exempt earthworks and retaining walls, including setbacks from boundaries, distance from natural water, drainage and separation from other walls.

The more accurate way to think about it is this: 600mm isn't an approval threshold on its own — it's just one of several things that have to line up. A short wall close to a boundary, near an easement, beside a drainage line, or in a sensitive area can still require approval, while the same wall elsewhere might not.
Where a wall doesn't qualify as exempt, it may still be able to go through the faster complying development pathway rather than a full development application, depending on the site and the works.

So rather than asking "how tall can I go without approval?", the better question is "what about my site changes the answer?"

Regulations vs. Standards: How Retaining Wall Rules Fit Together in Australia
It helps to understand two different things that often get lumped together.
Retaining wall standards in Australia are the national technical benchmarks that guide how a wall should be designed and built — the engineering side.
Regulations, on the other hand, are the planning rules that determine whether you need approval and which pathway applies — and these are set at a state and local level, which is why they differ across the country.
So while the underlying construction standards are broadly national, the approval requirements you'll actually deal with are shaped by NSW planning rules and your specific council.
In practice, that means two homeowners following the same Australian design standards can still face very different approval journeys depending on where they live. It's why we always come back to your particular site and local requirements rather than assuming a one-size-fits-all answer.
What Can Change the Approval Requirements?
Several factors can shift a wall from straightforward to needing approval — and often they matter more than height:
Distance to boundaries — walls close to a boundary are treated differently from walls set well inside it.
Easements and services — stormwater, sewer and water assets can restrict where a wall can go.
Nearby water — proximity to a natural waterbody can affect both approval and how you're allowed to excavate.
Existing retaining walls — walls built close together can be assessed as one larger structure.
What sits above the soil — driveways, pools and buildings add load (more on this below).
Site sensitivities — heritage, flood-prone, bushfire-prone and similar overlays each add their own controls.
Because these interact, two walls of identical height on different properties can face completely different requirements.
What Is the Wall Actually Retaining?
Here's a question most homeowners never think to ask: what happens if the wall fails?
A wall holding back garden soil is dealing with very different conditions to a wall holding back a driveway, a pool, a deck, a building or a neighbouring property.
Anything sitting on top of the retained soil adds extra pressure to the wall — these are often called surcharge loads — and they can significantly change what the wall has to be designed to withstand.
So a modest-height wall retaining nothing but garden bed is not the same engineering problem as the same-height wall beneath a driveway or pool. The height might look identical; the risk is not.

The Site Investigations That May Come First
On a genuinely constrained site, a few things usually need to happen before you have an approvable design.
Not every wall needs all of these — but on the sloping, coastal, treed and former-mining land common across the Hunter, it's normal to need several. This is a core part of thoughtful site analysis and ground condition assessment.
A detailed site survey — establishing exact levels, boundaries, easements and the true retained height, which drives the whole design.
Understanding how water moves — where surface and ground water flow, and where it can legally and safely discharge.
Easements and services — building over or near a water authority's assets can trigger a separate application and approval, independent of council.
Rock and excavation conditions — rock beneath the surface affects cost, machinery and whether a conventional footing is even viable. Sometimes the answer is a different footing, or splitting one tall wall into lower, tiered walls — though tiers built too close together can be treated as a single, larger structure.
Ground conditions and loading — soil type, reactivity and groundwater all inform footing design and how the wall carries load.
Soil and environmental sensitivities — in some low-lying and coastal areas, disturbing the ground can raise additional assessment and management needs.
Mine subsidence considerations — parts of the region carry extra development controls tied to former mine workings.
Trees — where trees sit near the wall line, excavation can affect their root zones and stability, and this often shapes where the wall can physically go.
Structural and drainage engineering — pulling it all together so the wall stands, holds its load, and manages water properly.
A Note for Hunter Region Homeowners: Water and Sewer Assets
This one catches people out. Across the Hunter, a wall that looks completely straightforward from a landscaping point of view can trigger a separate review if it sits over or near water and sewer infrastructure.
Hunter Water requires development plans to be checked so their assets are protected, and where a wall is over or close to an asset, a separate Build Over Assets application can be required on top of council approval.

It's exactly the kind of step that runs quietly alongside council and surprises homeowners late in the process — which is why it's worth checking early.
Mine Subsidence: A Local Consideration
Parts of Newcastle, Lake Macquarie and Maitland fall within declared Mine Subsidence Districts, tied to the region's coal mining history. In these areas, development can carry an additional approval or design consideration that wouldn't apply elsewhere, and approval from Subsidence Advisory NSW is generally sought before council lodgement. It's also linked to your eligibility for subsidence compensation, so it isn't a step to skip.

This doesn't mean every wall in these areas is complicated — just that the pathway shouldn't be assumed from wall height alone.

A Retaining Wall Is Part of a Bigger Landscape
This is really the heart of how I approach it.
A retaining wall isn't an isolated structure you drop onto a slope — it's one part of how the whole site works: levels, drainage, access, planting, and how you actually want to live in the space.
When a wall is designed as part of that bigger picture, it does far more than hold back soil.
It creates usable terraces, resolves water, protects what's around it and quietly disappears into a landscape that simply works.
When it's designed in isolation, it can solve one problem while creating several others. This is exactly why sloping landscape design is worth getting right from the start.
Before You Build: 10 Things to Check
A quick checklist worth running through before committing to a retaining wall:
What is the existing ground level?
How high does the wall actually need to retain?
What sits above the retained soil — garden, driveway, pool or building?
How close is the wall to the boundary?
Are there existing retaining walls nearby?
Are there easements, sewer or water assets in the way?
Where will surface and subsoil water go?
Are there significant trees close by?
Is the property affected by flooding, bushfire, heritage or sensitive soils?
Does the area carry any mine subsidence controls?

What This Means for Your Budget — and Your Enjoyment
A retaining wall isn't priced simply by its height and length. Excavation, access, rock, drainage, engineering, materials, soil conditions, disposal and approvals can all materially change the final cost — sometimes dramatically between two sites that look similar from the street.
That's exactly why the why question at the start matters so much. If the wall genuinely solves a site constraint — securing your home, stabilising a slope, making a steep block liveable — then that investment is buying safety, compliance and a space you'll truly use, and the return is real.
If it's mainly for a tidier, flatter look, it's worth making sure the design is built around how you actually want to live in the space, so what you spend comes back to you as everyday enjoyment.
